These Terms of Service govern your use of TruckProfit located at truckprofit.com.au. By creating an account or using the app you agree to these terms. If you do not agree please do not use TruckProfit.

TruckProfit is operated by TUFF KANGA PTY LTD ABN 87 637 423 619 .

1. The service

TruckProfit is a web and mobile application that helps Australian owner-drivers and fleet operators calculate job profit, manage quotes, track maintenance costs, and estimate GST obligations.

We offer a free plan and paid subscription plans (Pro and Fleet) as described on our pricing page.

2. Your account

You must provide accurate information when creating your account. You are responsible for keeping your login credentials secure. You must not share your account with others or allow others to access your account.

You must be at least 18 years old to create an account.

We reserve the right to suspend or terminate accounts that violate these terms.

3. Acceptable use

You agree to use TruckProfit only for lawful purposes related to your transport or logistics business. You must not:

• Use the app for any illegal purpose
• Attempt to gain unauthorised access to our systems
• Interfere with or disrupt the app or its servers
• Scrape, copy or reproduce any part of the app without our written permission
• Reverse engineer or attempt to extract the source code of the app

4. Subscriptions and payments

Free plan: Available to all users at no cost with the features listed on our pricing page.

Pro plan ($19/month AUD): Billed monthly. Includes all features listed on our pricing page at the time of subscription.

Fleet plan ($49/month AUD): Billed monthly. Includes all Pro features plus multi-driver access as listed on our pricing page.

All prices are in Australian dollars and include GST where applicable.

Payments are processed securely by Stripe. Your subscription renews automatically each month until you cancel.

5. Cancellation and refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have paid for.

We do not offer refunds for partially used subscription periods except where required by Australian Consumer Law.

If you cancel within 14 days of starting a paid subscription for the first time and have not made significant use of paid features we will consider a refund request on a case by case basis. Email billing@truckprofit.com.au.

6. Important disclaimer — calculations are a guide only

TruckProfit provides profit calculations, cost estimates and financial summaries as a guide to help you make business decisions. These calculations are based entirely on the information you enter.

The results are estimates only. They do not constitute financial advice, tax advice, or accounting advice. You should not rely solely on TruckProfit calculations when making business or financial decisions.

We strongly recommend you consult a qualified accountant or financial adviser for advice specific to your business situation. GST estimates provided by TruckProfit are indicative only and should be verified with your accountant before lodging your BAS.

7. Limitation of liability

To the maximum extent permitted by Australian law, TruckProfit and its operators are not liable for any loss or damage arising from:

• Errors or inaccuracies in calculations due to incorrect data entered by you
• Business decisions made based on TruckProfit results
• Loss of data due to technical failure
• Interruptions to the service
• Any indirect, incidental or consequential loss

Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose, or $100 AUD, whichever is greater.

Nothing in these terms excludes your rights under the Australian Consumer Law including guarantees that cannot be excluded.

8. Intellectual property

TruckProfit, its design, code, content, logo and branding are owned by us. You may not copy, reproduce, distribute or create derivative works from any part of TruckProfit without our written permission.

Your job data and the information you enter belongs to you. We claim no ownership over your data.

9. Privacy

Your use of TruckProfit is also governed by our Privacy Policy available at truckprofit.com.au/privacy. By using the app you agree to our Privacy Policy.

10. Changes to these terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or by a notice in the app at least 14 days before the changes take effect. Continued use of the app after changes take effect constitutes acceptance of the new terms.

11. Governing law

These terms are governed by the laws of the state of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
